TERMS AND CONDITIONS

These terms apply to www.brassballs.co.za, our funnels and order pages, our online courses and members area, and every product or service sold by Floor & Co. trading as Brass Balls Marketing ("Brass Balls Marketing", "we", "us"). By placing an order, creating an account or using this site you agree to these terms. If you do not agree, please do not use the site or buy from us.

Brass Balls Marketing is a South African marketing education and services business operated by Floor & Co. trading as Brass Balls Marketing. Support: support@brassballs.co.za. We respond on South African business days.

Physical products. The paperback edition of Make Them Come To You. Where the book is offered as "free, you cover shipping and handling", the amount charged is the shipping and handling fee stated on the order page. Delivery is to South African addresses only unless the order page says otherwise.

Digital products. Ebooks, audiobooks, PDFs, templates and online courses (including the Reader Implementation Companion, the 30-Day Convergence Engine Sprint, the Market Message Offer Starter Kit, the Specialist Implementation Labs and bonus courses). Digital products are delivered by email and/or through your members area at www.brassballs.co.za/school, usually within minutes of a successful payment.

Services. Consulting, done-with-you and done-for-you marketing services are sold under a separate written agreement.

All prices are in South African Rand (ZAR) and include VAT where applicable, unless the order page says otherwise. Payment is processed by Stripe. We do not see or store your card details. An order is accepted when payment has been successfully processed and you receive an order confirmation email. Order bumps and one-click upsells are optional additions to your order; the price of each is shown before you accept it, and accepting charges the card used for the original order.

Payment plans (for example 2 payments of R549) are a series of scheduled charges to the same card. You authorise all instalments when you accept the offer. Access to the product depends on the instalments being paid; if an instalment fails and is not settled within 7 days after we notify you, we may suspend access until it is settled.

Physical books are dispatched by courier within South Africa. You will receive a shipping confirmation with tracking details when the parcel is collected. Delivery times depend on the courier and your location. Please make sure your delivery address and mobile number are correct; we are not responsible for parcels sent to an address you entered incorrectly. If a courier confirms a parcel as lost, or your book arrives materially damaged, email us with your order number (and a photo of the damage) and we will send a replacement at no charge.

Book order (shipping and handling fee). If you are not satisfied, you may request a refund of the shipping and handling fee within 30 days of your order. You keep the book.

Digital products and courses. Unless a different guarantee is stated on the order page, every digital product and course carries a 30-day money-back guarantee: email support@brassballs.co.za within 30 days of purchase with your order number and we will refund the purchase price in full. We may ask which part of the product you worked through so we can improve it; your refund does not depend on the answer. On refund, access to the refunded product is removed.

Your statutory rights. Nothing in these terms removes your rights under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002, including the right to cancel an electronic transaction within 7 days of receiving goods or concluding a transaction for services, subject to the exclusions in section 42 of the ECT Act. Our 30-day guarantees are in addition to, and are more generous than, those rights.

Refunds are paid to the original payment method. Your bank or card issuer controls how long it takes to reflect (usually 5 to 10 business days).

When you buy a digital product or course you receive a personal, non-transferable, non-exclusive licence to use it for your own business education. You may not copy, share, resell, sublicense, publicly display or distribute any part of it, share your login, or use it to create a competing product. All content, including the Convergence Engine framework, worksheets, videos and course materials, remains the intellectual property of Floor & Co. trading as Brass Balls Marketing or its licensors. We may suspend accounts that breach this clause; no refund is due in that case.

We sell education and tools, not outcomes. Any examples, figures, testimonials or case studies on this site show what specific people did in specific circumstances. They are not a promise, guarantee or forecast of what you will earn. Your results depend on your market, your offer, your effort, your budget and factors we cannot control. Where a testimonial is used, it reflects that customer's own experience. Nothing on this site is financial, legal or tax advice.

You are responsible for keeping your login details confidential and for everything done under your account. Give us accurate information and keep it up to date. Do not use the site or members area to upload unlawful content, interfere with the service, or harass other members or our team.

To the extent permitted by South African law, our total liability to you for any claim arising from a product or service is limited to the amount you paid us for that product or service. We are not liable for indirect or consequential loss, loss of profit, or loss of data. Nothing in these terms limits liability that cannot be limited by law, including liability under the Consumer Protection Act.

Our site, checkout, email and members area run on systeme.io (marketed in South Africa as SCALR); payments run on Stripe; parcels are delivered by third-party couriers. Their services are subject to their own terms. We are not responsible for outages or errors on their platforms, but we will help you resolve any problem with your order.

How we collect and use your personal information is explained in our Privacy Policy, which forms part of these terms.

We may update these terms from time to time. The version on this page at the time of your order applies to that order. Material changes will be dated at the top of this page.

These terms are governed by the laws of the Republic of South Africa. If you have a complaint, email support@brassballs.co.za first; most issues are sorted out within a few days. You may also approach the Consumer Goods and Services Ombud or the National Consumer Commission. The courts of South Africa have jurisdiction over any dispute that cannot be resolved.
